-CA term extended by a year PM to resign within a week

KATHMANDU, May 28: The term of the Constituent Assembly has finally been extended for a year with 580 votes in favor and five against, at a meeting of parliament that began at 11:45 pm on Friday.
Speaker Subas Nembang announced the term extension at 1:25 a.m.
The CA extension became possible after the three major parties -- UCPN-M, NC and UML-- which between them hold a two-thirds majority in the CA sealed a three-point deal late in the evening Friday.
Top leaders of the three parties had struggled throughout the day over the specificity of the agreement and its wording. But they finally agreed on the text of the deal at around 11 p.m. and it was signed by UCPN-M Chairman Puspha Kamal Dahal, NC Acting President Sushil Koirala and UML Chairman Jhala Nath Khanal.
One thing that is still not clear in the three-point deal is within how many days Prime Minister Madhav Kumar Nepal will resign. Despite Maoist insistence on naming a specific date for the PM´s resignation, NC and UML leaders refused to do so.
Even after the signing of the agreement, Maoist Chairman Dahal was insisting that the prime minister will have to resign in the next three or four days but UML leaders were arguing that he could resign in a week´s time.
The deal brings to an end a political deadlock plaguing the country for the last one year since Maoist Chairman Pushpa Kamal Dahal resigned as prime minister after his failed attempt to sack then army chief Rookmangud Katwal.
Out of power, the UCPN-M launched a series of protests to force the government into a compromise, if not to remove it from power.
On May 1 it had announced an indefinite general strike demanding resignation of Prime Minister Madhav Kumar Nepal. Following their general strike debacle, the Maoists had maintained that they would not agree to extend the CA term unless Prime Minister Nepal resigned.
The general election for the CA was held on April 10, 2008. The two-year term of the CA to draft a new constitution expired at midnight Friday.
-Politics ahead
Though the parties have agreed to extend the CA they are yet to reach an agreement on a number of complicated issues. They will now have to negotiate and agree on three key issues -- taking the peace process to a logical end, writing the constitution, and power sharing.
The parties have agreed that they will soon begin negotiations on each of these issues and will reach a comprehensive deal before a new national consensus government is formed. The parties are yet to agree on who will lead the national consensus government.
-Three-point agreement
1. We are firmly committed to consensus and cooperation to take the peace process to a logical conclusion and to immediately complete the remaining tasks of the peace process and accomplish the historic responsibility of writing a new constitution.
2. Though significant progress has been made toward constitution drafting process, all the works have not been completed yet. So we have agreed to extend the term of the Constituent Assembly by one year.
3. We are ready to move ahead on the basis of consensus to accomplish the above-mentioned responsibilities and works as soon as possible by forming a national consensus government. We would like to make it clear that the prime minister of the present coalition government is ready to resign as soon as possible.
-UNMIN hails deal
The United Nations Mission in Nepal (UNMIN) has welcomed the agreement of the parties to extend the CA term."I welcome the decision by the parties to take the necessary steps to extend the tenure of the Constituent Assembly. The parties now have a precious opportunity to address outstanding peace process issues without further delay," UNMIN Chief Karin Landgren told myrepublica.com.

-प्रधानमन्त्रीको "टङ्ग स्लीप" मा एमालेको धारणा

०६७ जेठ ७ गते नेकपा एमाले का वरिष्ठ नेता तथा वर्तमान सरकारका प्रधानमन्त्री कमरेड माधव कुमार नेपालद्वारा अभिव्यक्त विचारप्रति पार्टीको गम्भीर ध्यानाकर्षण भएको छ । त्यस दिन उहाँले नर्वेली वातावरण तथा विकास मन्त्री एरिक सोल्हेमसँग त्रिभूवन अन्तर्राष्ट्रिय विमानस्थलमा भएको भेटवार्तापछि संवाददाताहरुसँग "पहिले त म संविधानसभाको पक्षमा पनि होइन । माओवादीहरुलाई खुशी पार्न राम्रो हुन्छ भने ठीकै हो भन्ने मान्यता बोकेको मान्छे हुँ । नभए त मैले संविधानसभा होइन अर्को माध्यमबाट पनि संविधान बनाउन सकिन्छ भन्ने प्रस्ताव राखेकै पनि हो ।" भन्ने कुरा व्यक्त गर्नुभएपछि आम नेपाली जनसमुदाय र पार्टीमा गम्भीर किसिमको भ्रम सिर्जना भएको छ ।
जनताबाट निर्वाचित बहुमतको सरकार बनाउनु मात्रै लोकतन्त्रको मर्म होइन । जनताले आफ्नो संविधान आफै बनाउनु पर्छ भन्ने मान्यता लोकतन्त्रको सबभन्दा महत्वपूर्ण विषय हो । त्यसैले नेपालको प्रजातान्त्रिक र वामपंथी आन्दोलनमा ००६ सालदेखि नै जनताले आफ्नो संविधान आफै बनाउनु पर्छ भन्ने मान्यता अघि बढ्दै आएको हो । यो कुनै एउटा पार्टीको माग नभएर कम्युनिष्ट र कांगे्रस सबै लोकतान्त्रिक पार्टीहरुको माग हो । मुलुकको शक्ति सन्तुलनको अवस्था र तत्कालीन विशिष्ट परिस्थिति अनुसार कहिले यो विषय मुख्य राजनीतिक मागको रुपमा अगाडि आयो भने कहिले यो भन्दा अर्को विषय प्रमुख माग बनेको बेला छायांमा पर्यो । तर पनि जनताले आफ्नो संविधान आफै बनाउन नसक्दासम्म जनताको आन्दोलनबाट प्राप्त सीमित अधिकारहरु वारम्वार खोसिने र राजाको निरंकुशता दोहोिरंदै जाने अवस्था नेपाली राजनीतिमा कायम रह्यो । त्यसैले खास गरी तत्कालीन राजा ज्ञानेन्द्रको प्रतिगमनपछि संविधानसभासँगै राजतन्त्रको अन्त्य गर्नुपर्ने विशिष्ट परिस्थिति उत्पन्न भयो । त्यसबेलाको परिस्थितिको विश्लेषणको आधारमा नेकपा एमाले ले संविधानसभा र लोकतान्त्रिक गणतन्त्रको मागलाई प्रमुख नाराको रुपमा एकैसाथ उठाएको थियो । यो विषयलाई व्यापक छलफलपछि पार्टी केन्द्रीय कमिटीले पारित गरेको थियो । त्यस्तै त्यसबेला राजाको निरंकुशता विरुद्ध संघर्षरत सात राजनीतिक पार्टीहरुले यो विषयलाई साझा नाराको रुपमा अघि बढाएका थिए । त्यसैले यो विषय नेकपा माओवादी को मात्र नभइ नेकपा एमाले लगायत अन्य पार्टीहरु र नेपाल राष्ट्रको समेत साझा विषय बनेको वास्तविक यथार्थतालाई बिस्रनु हुँदैन ।
संविधानसभाबाट नै संविधान निर्माण गर्नु पर्ने विषयमा नेकपा एमाले ले जोड दिएको छ । त्यसको लागि राष्ट्रिय सहमति अनिवार्य छ । सहमतिको लागि पार्टीले निरन्तर प्रयास जारी राखेको छ । यस्तो अवस्थामा पार्टीका वरिष्ठ नेताबाट आएको अभिव्यक्तिले संविधानसभा बारे पार्टीको दृष्टिकोण सम्बन्धमा भ्रम सिर्जना हुने भएकोले त्यस्तो भ्रममा नपर्न र पार्टीले पटक-पटक गर्दै आएका संस्थागत निर्णयको आधारमा अघि बढ्न पार्टी पंक्ति र आम जनसमुदायलाई नेकपा एमाले हार्दिक आह्वान गर्दछ ।

-No surrender is possible, PM

Maoist is demanding the resignation of Prime Minister, Madhab Kumar Nepal as only a solution of current political conflict but Prime Minister rejected it directly saying "no surrender is possible in front of Maoist's intimidation" rather Nepal suggested to Maoist, to be civilian party. Speaking on the occasion of 21st anniversary of the Youth Federation Nepal, Nepal enforced in uniformity and consensus for the peace process and constitution among political parties.
Addressing the anniversary, PM said, "resignation requires certain pre-requisites as crime and out of constitutional procedures but no clamor in the street" he further said, "we can not trust the credit commitment of Maoist that they are violating since long". He also requested to control speeches in public and do not take my mild manner as weaknesses.
Prime minister clearly said, "to grasp the power forcefully is impossible" who the tiger and who the fox is already shown by incidents, that Maoist mentioned "we are tiger and the rest are fox" dirung strike. Even though the way is open to join in government for peace and constitution, he added.

-116 Nepalis in Libya, Sudan await rescue

KATHMANDU, May 12: Ninety-four Nepali laborers working for a company in the north African country of Libya have appealed to the Nepal government for immediate rescue, saying they are being forced to work in miserable conditions.
The plight of the workers came to light after the Nepali Embassy in Cairo, Egypt wrote to the Ministry of Foreign Affairs (MoFA) here Tuesday, informing the government about the matter.
"We have been informed that the workers have been working as bonded labor and have been deprived of their basic salary for as many as nine months," said a senior MoFA official, preferring anonymity.
The workers, in a joint appeal sent to the Department of Employment Promotion on April 25 through the embassy, said they were duped by their agents who promised them work at CKG, a multi-national company with expertise in carrying out projects of a civil and mechanical nature. But they ended up being associated with Gorkhas Construction Pvt Ltd in Libya, according to a letter in the possession of Republica. The former company is already in the process of closing down, according to them.
Following receipt of the letter, the Nepali mission in Cairo carried out a study and found that the labors were working in vulnerable conditions.
"They are awaiting immediate rescue," the official said quoting the letter from the embassy. MoFA sources further said that approximately US$ 141,000 - which covers air tickets and compensation to the employer company - is needed to rescue them.
In the letter sent to the Department of Employment Promotion, the laborers said they reached Libya through Dhaulagiri Manpower Company and sought action against it.
In yet another case, the Nepali mission in Riyadh has also written to the government informing it that 22 Nepali laborers in Sudan have appealed for immediate rescue, saying they are being forced to work as bonded labor in poor conditions at the Khartum-based Fresh Soap Factory.
The government does not yet recognize Sudan as a labor destination and sending Nepali workers to the northeast African country is considered illegal.
According to MoFA officials, the company is ready to let the Nepali workers return if they are provided air tickets and compensation paid for terminating the contract. Officials said approximately US$ 3,300 is needed to rescue the laborers from Sudan.

-Journalists Became Target of Maoist

Maoist besieged the main government administration centre, Singh Durbar withdrawing the infinite general strike was pressurized by national and international community. Obviously, Maoist held the mass assembly was addressed by Puspa Kamal Dahal, president of UCPN-Maoist said journalists are not supporting their strike and challenged that, people knew very well about their negative role.
Maoist cadre attacked a passer way saying 'vigilante' in their agitation by iron rod and journalists are taking picture and visual, they also attacked by demonstrators. Prabin Maharjan of Associate News Agency, photo journalist and Rabindra Shrestha of Avenues Television cameraperson were bitten up by them. They also broke the cameras and vandalize several vehicles.
During the meeting with the delegates of Photo Journalists Forum, Prime-Minister Madhab Kumar Nepal committed to protect press freedom and urged not to excite the cadre to attack press for their own interests. Meanwhile Nepal said, he would not resign through violence and intimidation of Maoist and sent letter to Puspa Kamal Dahal for negotiation.

-Peace Rally held in Kathmandu

A Peace Rally held in Basantapur, Kathmandu demanding political solution through dialogue among the political parties regarding the indefinite general strike called by Maoist which begun to stop the life of people in the country, today. Thousands of people from different organizations; civil society, press, Nepal bar Association, and individuals were participated which was organized by The Federation of Nepalese Chambers of Commerce and Industry (FNCCI) in Kathmandu. Even, Maoist leaders pressurize not to organize the Peace Rally, thinking it is against their strike, to civil society and stopped participants on the way to Basantapur in Kupondol and Rantapark by Maoists activists.
Addressing the mass in Basantapur, president of FNCCI, Kush Kumar Joshi claim that, end of the chaotic situation of Nepal and restoration of peace and completion of constitution is the aim of this Rally, was also addressed by president of Nepal Bar Association and famous comedians 'Maha Jodi'. Later, the rally was marched through New Road, Bir Hospital, Jamal, Ratnapark but clashed with Young Communist League, YCL while they create obstacle in exhibition road.
Sixth day of strike called by Maoist, scattered the life of people, especially those who works daily for their livelihood, even if they claim about civilian supremacy and right and welfare of proletariat. There are also anti-strike agitations by local people in many places throughout the country, is their agony of strike without any outlets. Minister of Information and Technology, Shankar Pokhral said the strike of Maoist is against the will of people and it can not give solution in present political deadlock.
Meanwhile, America appeal to withdraw the indefinite general strike through press release in the name of Robert O. Blake, Nominee for Assistant Secretary of State for South Asian Affairs Department of State, expressing their concern about the life of general public.

-कामदार कोषबाट मन्त्रीको विदेश सयर

कन्तिपुरबाट प्रकाशित समाचार - काठमाडौ, मंसिर १४ - विदेशमा काम गर्न जानेबाट उठाइएको कल्याणकारी शुल्कको एक करोड रुपैयाँ खर्चेर श्रममन्त्रीसहितका विशिष्ट पदाधिकारीले विदेश भ्रमण गरेका छन् । कामदारबाट सुरुमा ५ सय र हाल हजार रुपैयाँ उठाइने गरेको कोषमा दुई वर्षमै २५ करोड जम्मा भइसकेको छ । 'वैदेशिक रोजगार प्रवर्द्धन गर्न' भन्दै श्रममन्त्रीको नेतृत्वमा विभिन्न टोलीले विदेश भ्रमण गरी एक करोड सिध्याएको हो ।
'आर्थिक मन्दीले नेपाली कामदारलाई परेको असर र रोजगारको नयाँ अवसर खोज्न विदेश जाँदा रकम खर्च भएको हो,' वैदेशिक रोजगार प्रवर्द्धन बोर्डर्का कार्यकारी निर्देशक स्थानेश्वर देवकोटाले कान्तिपुरसँग भने ।
हालका श्रममन्त्री मोहमद अफ्ताव आलम र अघिल्लो सरकारका श्रममन्त्री लेखराज भट्टले यो रकम सकेका हुन् । गत वैशाखमा भट्टको नेतृत्वमा कतार, साउदी अरब र यूएईको अध्ययन गर्न एउटा टोली गएको थियो भने त्यसपछि आलम इजरायल, जापान, गि्रसलगायतका मुलुक घुमिसकेका छन् । त्यसमध्ये इजरायल भ्रमण मन्त्रिपरिषदको अनुमतिबिना गएकाले विवादित बनेको थियो ।
'कामदारको मृत्युमा निजको शव ल्याउन वा दुर्घटना परेमा उपचार गर्नका लागि उपयोग हुनुपर्ने कोषको रकम विदेश भ्रमणमा दुरुपयोग भइरहेको छ,' श्रममामिला विज्ञ गणेश गुरुङले भने । स्रोतका अनुसार श्रम मन्त्रालयका फुटकर खर्चसमेत कोषबाटै भुक्तानी गर्न थालिएको छ । बोर्डका अध्यक्ष श्रममन्त्री हुन् । एक कर्मचारीले भने, 'कतिसम्म भने मन्त्रीले पाहुनालाई खुवाएको चियाबिस्कुटको समेत बिल आउन थालेको छ ।' वैदेशिक रोजगार ऐनअनुसार कामदारको सुरक्षाका लागि गठित कल्याणकारी कोष स्थापनाको दुई वर्षसम्म पनि कामदार सुरक्षाका कुनै कार्यक्रम आएको छैन । 'कोषमा सरकारका तर्फबाट पनि रकम जम्मा गर्नुपर्ने प्रावधान छ,' गुरुङले भने, 'तर सरकारले पैसा जम्मा गर्नु त कता हो कता मामाको धन फुपूको श्राद्धझैं पो गर्न थालेको छ ।
'ऐनअनुसार कोषको रकमबाट विदेशबाट फर्केका कामदारका परिवारको शैक्षिक विकास, स्वास्थ्य उपचारमा सहयोग, महिला कामदारका लागि सुरक्षित गृहको र तिनका बालबच्चाका लागि शिशुस्याहार केन्द्र सञ्चालन, वैदेशिक रोजगारसम्बन्धी जनचेतना र बोर्ड सञ्चालन गर्ने व्यवस्था छ ।
कोषबाट हालसम्म करिब पाँच करोड खर्च भइसकेको कार्यकारी निर्देशक देवकोटाले बताए । उनका अनुसार दुई सय ३८ मृतकका परिवार, आर्थिक मन्दीबाट फर्केका दुई सय ३३ कामदार, अंगभंग भएका १२ कामदारलाई क्षतिपूर्ति, अभिमुखीकरण तालिम लिएका ९ सय ३९ महिलालाई सात सय रुपैयाँका दरले सोधभर्ना दिइसकिएको छ । मृतक परिवारलाई भने एक लाख रुपैयाँ क्षतिपूर्ति दिने गरिएको छ ।

-Six labor attaches appointed ignoring criteria

KATHMANDU, May 1: The Ministry of Labor and Transport Management (MoLTM) has appointed labor attaches for six different labor destinations, ignoring even reasonable minimum qualifications.
MoLTM has decided to appoint Under Secretaries Kashi Raj Dahal and Krish Hari Puskar Karna as labor attachés for Japan and South Korea respectively.
Similarly, Section Officers Bhabiswor Pandey has been appointed labor attache for Hong Kong, Bishnu Hari Upadhya for Oman, Murari Osti for Israel and Bishal Bhattarai for Kuwait. Of the newly appointed, only Bhattarai has experience in the foreign employment sector and a good knowledge of English.
In a bid to ensure fair selection of labor attaches, the Ministry of Finance (MoF) had given consent to the creation of new labor attache posts, laying down the condition that they should be selected through internal competition among candidates who have a good command of English and knowledge of the foreign employment sector.
A source at MoLTM told Republica that Dahal is currently at the Department of Health Services, Upadhya is personal assistant to Peace Minister Rakam Chemjong, and Osti is at the Home Ministry.
“Except for Bhattarai, the appointees don´t have minimum qualifications to be labor attaché and they were appointed entirely out of the personal interests of Labor Minister Mohamad Aftav Alam. This has created resentment among the employees,” said the source. Bhattarai has been working at the foreign employment division of MoLTM since the last three years.
To exercise his discretionary powers in appointing labor attaches through direct proposal to the cabinet, Alam has set aside the necessary qualifications specified by an earlier cabinet meeting.
“The ministry has not only ignored minimum qualifications but even a single woman has not been selected for the post,” the source added.
Though Karna and Pandey were transferred to MoLTM a couple of months back, they had not been assigned any responsibility to obviate the need for consent from the Ministry of General Administration (MoGA) for appointing them as labor attaches and forwarding their names to the Ministry of Foreign Affairs. As per the existing practice, employees should not be kept without responsibilities for long.
MoLTM has not had to sent the names of Karna and Pandey for MoGA´s consent.
The appointment of Labor attaches to Malaysia, Qatar, the United Arab Emirates and Saudi Arabia was also controversial as they were appointed without following any criteria.
As per the Law Act 2007, the government can appoint labor attaches to countries where the number of Nepali workers exceeds 5,000.

-General Strike of Maoist

The indefinite general strike called by Unified Communist Party of Nepal-Maoist (UCPN-M) with the purpose that alteration and leading the government, stroked the life of people resentfully, nationwide. Maoists has celebrated the 121st May Day 2010, carrying much supporter was from out of Kathmandu valley to sustain their strike which already was announced by them.
Maoists mainly demanded the resignation of Prime-Minister Madhab Kumar Nepal and build the government leading by Puspa Kamal Dahal, the Maoist leader, with the claim that they are the largest party in Constituent Assembly, CA election, superficially. On the other hand, government, except the Maoist, claim that there is the legal way to hold the government not from the demonstration on the street with innocent people but from the legal process, which can be the proposal of suspicion in parliament or through the negotiation and consensus among the political parties for the completion of constitution. Meanwhile, the government could not believe the Maoist commitments because of their reciprocal activities, capturing the public and personal properties and their mutual armed as well as the bi-armed force Young Communist League, YCL.
Condition of people and their livelihood in Kathmandu is getting worse because of strike, and the demonstrator are also getting sick with the lack of proper accommodation are from outside of capital and leaving the spot gradually. In some places, there are also anti-strike agitations by local residential because of indefinite strike and obligations of donation with threaten that causing the strike less effective is a challenge for Maoist. The local people had played the decisive role in every milestone of revolution like crumble of Panchyat system and achieving multi-party democracy as well as republican instead of monarchical but now they seems against the strike, is another challenge to Maoist. There is also compulsion of support and participate in demonstration to Maoist which cause dead of an old man in Dang, who was compel to go in anti-government demonstration. On the other hand, government clearly noted that, Prime-Minister should not resign with the pressure by street and such hullabaloo, but in negotiation and consensus through proper way and holding negotiation with Maoist.
Strategically, Maoist have hidden desire to hold the government and make the constitution in their favor along with the name and fame, and unification of Maoist arm in Nepal Army as they like, but situation is out of their control that appeared in clash between the activists in several places as well as the stand taken by government.
